Welcome to BlueLaVaMedia! By scheduling a service with us, you agree to the following terms and conditions. These are designed to ensure a smooth and professional experience for all parties involved.

1. Services Provided

BlueLaVaMedia offers professional real estate media services, including photography, aerial drone imagery, virtual tours, and video walkthroughs. Each service includes basic editing (exposure, color correction, contrast, and sharpening). Advanced edits such as object removal, sky replacement, or virtual staging are available upon request for an additional fee.

2. Delivery Timelines

We strive to deliver your media promptly:

  • Next Day Delivery: Still Photography

  • 48-Hour Delivery: Zillow Showcase Bundle, Aerial Drone Video & Photos, 360 Panoramic Photography, Agent Intro & Social Media Videos, Floor Plans (Measurements Only), Interior Video Walkthroughs, Twilight Photography, Virtual Staging

  • 72-Hour Delivery: Interactive Floor Plans, Enhanced Property Lines

Please note: We are closed on Sundays and National Holidays. Delivery times may vary based on service complexity and scheduling.

3. Payment Terms

Payment is due in full before the final media is delivered. Pricing is based on the selected service package and the time spent on-site. Additional services or extended on-site time may incur extra charges, which will be communicated in advance.

4. Licensing & Usage Rights

Clients are granted a non-exclusive, non-transferable license to use the delivered media solely for marketing the specific property for which the services were rendered. This includes usage on MLS listings, print materials, websites, and social media platforms.

Media may not be sold, transferred, or distributed to third parties (e.g., builders, stagers, other agents) without prior written consent from BlueLaVaMedia.

5. Copyright

All media produced by BlueLaVaMedia is protected under U.S. Copyright Law. We retain full ownership of all content. Clients are provided with a license to use the media as specified in Section 4.

6. Cancellations, Rescheduling & Refund Policy

At BlueLaVaMedia, LLC, we strive to get to your listings as quickly as possible. We’re committed to delivering high-quality media with industry-leading speed and affordability. During our busiest times of the year, we typically reach your shoot location within 7–10 days, thanks to our dedicated team of professional photographers and drone pilots.

That said, we understand that real estate moves fast, and occasionally listings may sell before we’ve delivered your final product. In these rare cases, we’ve established a fair cancellation and refund policy that considers both your needs and the time our team has invested.

Cancellation & Refund Schedule:

  • Before We Arrive On-Site:
    A full refund will be issued.

  • After Arrival But Before Shooting Begins:
    A $65 fee will be deducted for time and travel.

  • After Editing Has Begun:
    A $125 fee will be deducted for the time spent capturing and editing your content.

  • After Delivery of Final Media:
    No refund will be issued once the media has been delivered.

Note:
Cancellations or rescheduling requests must be made at least 48 hours in advance to avoid incurring any cancellation fees. Weather-related rescheduling will always be accommodated without penalty.

7. Property Preparation

Clients are responsible for ensuring the property is ready for the scheduled shoot. This includes cleaning, staging, and ensuring all areas are accessible. Our photographers do not move furniture or personal items. A property preparation checklist is available to assist you in getting ready for the shoot.

8. Liability

BlueLaVaMedia is not liable for any damage, loss, or injury that occurs at the property during the shoot, except in cases of gross negligence or willful misconduct by our staff.

9. Dispute Resolution

This agreement is governed by the laws of the State of Michigan. Any disputes arising from our services will be resolved in the courts of Grand Traverse County, Michigan. Prior to legal proceedings, both parties agree to attempt resolution through mediation or arbitration.

10. Travel & Mileage

Mileage fees apply to all appointments outside a 30-mile radius of downtown Traverse City, Michigan. Properties located beyond this range will be charged $1 per additional mile, based on round-trip distance.
